TERMS OF USE

This website https://transferit.gr/ (hereinafter referred to as the "Site") is owned by the société anonyme under the name "Soft One Technologies Société Anonyme" (hereinafter referred to as "SoftOne"), seated at Kallithea, Attica (8 Achilleos Street, P.C. 17674).

The use of the electronic pages and services of the Site by the visitor/user implies their unconditional acceptance of these terms of use, which are applicable to the whole content, pages and files included in the Site (hereinafter "Terms of Use"). Therefore, you must read these Terms of Use carefully before using the services of the Site.

SoftOne reserves the right to unilaterally modify the Terms of Use and any integral part thereof, at any time and without prior notice. SoftOne will upload the Terms of Use as in force from time to time, in order to keep visitors/users informed. Therefore, you are advised to review the content of the specific pages periodically for any amendments. The continuous use of the pages and/or services of the Site, even after any amendments occurred, implies your unconditional acceptance of the amended Terms of Use.

If you do not agree with these Terms of Use, please refrain from any action to access and use the Site https://transferit.gr/ and in any case do not use its services and content, as access and use of the Site https://transferit.gr/ implies your acceptance of all the Terms of Use.

Transferit Services

Through the Site, SoftOne provides you with an electronic file transfer service (hereinafter referred to as the "Transferit Services").

Every time you use the Transferit Services, you must upload the files to be transferred (hereinafter referred to as the "Content") and enter the email addresses of one or more recipients. You will then be sent a confirmation code, following the respective insertion of which, within a specific period of time, the intended transfer of the Content will be carried out through the Transferit Services.

The respective Content will be stored on SoftOne's servers for a specific period of time, which will not exceed ten (10) days, after the expiration of which the possibility of electronic transfer will cease, and the Content will be permanently deleted, with no capability of retrieval.

Granted Right of Use – Fees

SoftOne grants you a non-exclusive and non-transferable right to use the Site https://transferit.gr/ for the purpose of using the Transferit Services.

The intellectual property rights of the information, software, technologies that support the operation of the Site https://transferit.gr/ remain in any case in the property of SoftOne, which is the operator of the Site. Neither is any right transferred to you, nor are you granted in any way, directly or indirectly, a license to use them.

The right to use the Site https://transferit.gr/ is granted in principle free of charge. However, SoftOne reserves the right, at any time, to provide for a payment (in the future) in the form of either a one-time fee or a subscription fee (monthly or annual) for the use of the Transferit Services or part of them. In this regard, SoftOne will notify you by e-mail or by uploading a notice on the Site https://transferit.gr/, setting out the procedure for the electronic conclusion of a contract.

Storage and reproduction of any part of the Content of the Site for commercial purposes or for any other use, including any registered trademarks or service trademarks of SoftOne or trademarks of affiliated entities that may appear on the Site, are strictly prohibited.

Restrictions of Use – User’s Obligations

When accessing the Site and using the Transferit Services, you must comply with the applicable laws and principles of morality and refrain from any illegal or abusive conduct. Indicatively and not restrictively, it is expressly prohibited to use the Transferit Services:

  1. in a manner that is prohibited by the applicable laws or that implies a violation of third parties’ rights,
  2. for the purpose of attempting to gain unauthorised access to any data, accounts or networks by any means,
  3. for the purpose of processing personal data of third parties without their consent,
  4. in a manner that affects or is likely to affect adversely or impede the use of the Transferit Services by third parties.

You further undertake that the Content to be transferred, by using the Transferit Services:

  1. will not be illegal or depict illegal activities, including but not limited to: images or any other content that violates the legal rights of third parties including copyrights, images of sexual abuse of adults and minors, images or any other content related to dangerous or criminal acts (e.g. rape, human trafficking, etc.), images or any other content related to illegal products and services (e.g. the sale of animal products under extinction, illegal drugs, over-the-counter medications although prescription needed, etc.)
  2. will not contain images that promote violence or show gratuitous violence,

III. will not relate to content produced by or on behalf of terrorist groups, promote terrorist acts, incite violence or praise terrorist attacks,

  1. will not contain obscene sexual material,
  2. will not contain dangerous or derogatory material, including but not limited to: content that advocates or threatens acts of self-harm or physical harm to others, harasses, insults, terrorizes or attacks an individual or group of individuals, incites hatred, promotes discrimination or denigrates a person or a group on the basis of race or ethnic origin, religion, disability, age, nationality, occupation, sexual orientation, gender, gender identity or any other characteristic associated with systemic discrimination or social marginalisation.

SoftOne reserves the right to set limits or terminate - at any time, immediately and without notice - your access and use of the Transferit Services, in the event of violation of the abovementioned restrictions and prohibitions on your end, in which case you will be held liable to indemnify SoftOne for claims arising from: (1) breach of these Terms of Use; and (2) a third party claim deriving from your unlawful use of the Transferit Services, including but not limited to breach of copyright or other rights, privacy or confidentiality.

SoftOne's obligations

SoftOne will make every effort to ensure the uninterrupted provision of the Transferit Services.

SoftOne will treat the Content as classified and confidential information of yours, and therefore it will not be responsible for or proceed to any examination of the Content.

SoftOne may from time to time carry out maintenance and audit services of its systems, as well as update the Site https://transferit.gr/ in order to add new functions and/or upgrade the existing ones. This may cause minor and/or prolonged interruptions in the operation of the Site during which you may not be able to access the Transferit Services. SoftOne will make reasonable efforts to minimize the downtime periods of the operation of the Site, but does not guarantee the effectiveness or success of such efforts.

SoftOne shall not be liable for any direct or indirect damage or harm that you may suffer from the use of or inability to use the Site https://transferit.gr/, from delays during its use, or from interruptions in its usability. SoftOne shall be liable only in cases of intent or gross negligence on its part and on the part of its agents, and up to an amount of one hundred and fifty (150) euros per case, to which amount you expressly agree that SoftOne's maximum liability is limited, while SoftOne shall not be liable for any other damage or harm caused to you.

During the operation of the Site https://transferit.gr/, SoftOne is bound by the applicable legislation as regards the confidentiality of communications made through its network, as well as by the 2016/679 General Data Protection Regulation of the European Parliament on the protection of individuals with regard to the processing of personal data and on the free movement of such data, as amended and in force, as well as by the entire applicable legal and regulatory framework, including any relevant European and national legislation, as well as the opinions and decisions of the Hellenic Independent Authority for the Protection of Personal Data.

Activation - Optional Account Creation

To activate and access the Transferit Services, you may opt to create an account by entering your e-mail address and password.

In the case of said optional account creation, you are responsible for maintaining the confidentiality of the password you use to access and use the Transferit Services and for amending it regularly for security reasons. Therefore, you will be solely responsible for the use of your account and will be liable for any action made while using the Transferit Services with your password.

SoftOne is not liable for any damage caused by any unauthorized use of your account. You should immediately notify SoftOne in case you become aware of any unauthorized use of your account and password or any other security breach.

Minors

The Site https://transferit.gr/ is intended for use by adults only.

Partial invalidity

If any article of these Terms of Use is found to be invalid or unenforceable, in whole or in part, the validity and enforceability of the remaining articles shall not be affected.

Exercise of Rights

SoftOne's failure to exercise its rights under these Terms of Use shall not constitute or be construed as a waiver of such rights.

Headlines – Interpretation

The headlines of the articles of these Terms of Use have been set for the convenience of users only. They do not in any way affect their interpretation. The interpretation of any term of these Terms of Use is not affected by its position within any article or by the position of that article in relation to the other articles.

Applicable law - Jurisdiction: These Terms of Use and any amendment thereof, as well as any dispute that may arise from them, shall be governed by Greek law. Greek law shall be the applicable law and the Courts of Athens shall have jurisdiction for the interpretation or resolution of any dispute arising out of the use of the Site https://transferit.gr/.
